Welcome to Warhammer Art our services and products are provided subject to the following terms and conditions. By using the website, you agree to be bound by these terms and conditions. For the purpose of these terms and conditions (T & Cs) Warhammer Art will be referred to as the “COMPANY”, Warhammer art .com will be referred to as “THE SITE” and you as the purchaser will be referred to as the “PURCHASER” and any person who accesses the site purchaser or not will be referred to as “YOU”. Terms of Use

By clicking the “I Accept” button, “YOU” agree to be bound by the terms of this legal agreement between “YOU” and Warhammer Art which sets out the terms and conditions (T & C’s”) relating to the use of the service provided via “THE SITE” which may contain links to other third-party sites. YOU acknowledge and agree that a) the “COMPANY” has no control over third-party sites which “YOU” link to through the site or via links to the site; b) we are not responsible for the availability of such third-party sites; c) we do not endorse and are not responsible or liable for any content, advertising, products or other materials on or available from such third party sites; and d)we are not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such third-party sites.

The “COMPANY” makes all reasonable efforts to ensure the accuracy of the information contained within the site, however, the “COMPANY” accepts no liability for any inaccuracies or mistakes that may arise and the “PURCHASER” will have no claim against the “COMPANY” in respect of these or their effect. The “COMPANY” reserves the right to cancel or decline any order from any person or business in any jurisdiction.

Acceptance

The order shall be concluded only when the “COMPANY’S” on screen Acknowledgment or order is sent and your payment by credit card or by check or any other acceptable means of a financial transaction has been authorised or cleared.

License and Website Access

We grant you a limited, revocable license to access and make personal use of the website as our customer. However, you are not permitted to:

Reproduce, duplicate, copy, sell or otherwise exploit the website or any product image, product listing, product description, price, page layout, page design, trade dress, trademark, logo or other content (“Website Content”) for any commercial purpose, except as expressly provided;

Any use of the website or Website Content that is not expressly authorized herein is prohibited and immediately terminates the license granted herein.

All Website Content is our property or the property of Games Workshop and is protected by international copyright laws. The purchase of any product does not provide the purchaser with any copyright interest or other intellectual property right in the product. All Website Content that is not our property is used with permission. The arrangement and compilation of all Website Content is our exclusive property and is protected by international copyright laws. All software used on the website is our property or the property of our software suppliers and is protected by international copyright laws.

For the avoidance of doubt you are not permitted to copy (whether by printing off onto paper, storing on disk or in any other way), distribute (including distributing copies), alter or tamper with in any way or otherwise use any material contained in this website.

The “PURCHASER” or any person accessing the site will acknowledge that all information, imagery, copyrights, designs, products, propriety information rights and any other information displayed on the site is solely the property of the “COMPANY” or its partners and belong to and be the absolute property of us automatically and without further formality on their coming into existence.

Products

The products contained within “THE SITE” may differ slightly in colour from the way they are represented from one computer monitor to another. What a customer may see on screen represents the colour “YOU” should expect to receive but can only be used as a guide, not an exact representation.

Pricing/Currency

All prices are displayed on the site and are inclusive of delivery and local taxes. Prices are available in Great British Pounds, US Dollars and Euros. In the event of a typographical or human error in relation to prices and sizes the “COMPANY” has the right to cancel orders and can accept no liability whatsoever.

Payment

Payment of goods can be transacted by credit card via the site. Where card details are taken online, our website uses industry-standard SSL technology to encrypt your card details as they are transferred to our server. Alternatively, payment can be made by check payable to the “COMPANY” or via any other acceptable payment method.

Payment Types

The “COMPANY” accepts all major credit cards and debit cards including Visa, Mastercard, and Switch. Unfortunately, we do not accept Amex.

Delivery

Once payment has been received by way of cleared funds “PURCHASERS” we will dispatch your order within 7 working days. Your order will be dispatch as per the delivery times stated on our shipping page. If in the unlikely event the product arrives damaged the “PURCHASER” must notify the “COMPANY” within 2 days of receipt of the product so the “COMPANY” can adhere to its insurance policy with its preferred delivery partners.

Returns and Refunds

Products are made to order and the “COMPANY” cannot offer a money back guarantee, however, if a customer is not entirely satisfied with the product they should inform the “COMPANY” within 7 working days and return the item appropriately packaged within 14 days of receipt of the product and the product can be replaced with a product of equal value. (Please note that the replacement will contain the same image as originally ordered). We can only accept returns due to damage if the goods have been logged as damaged upon receipt and the couriers have been informed as per the terms. When you return a Product to us we will ship the replacement within 7 days.

Please note that the right to cancel a contract and return Products does not apply to any on-demand made to order products – although you do have the right to reject any Product which is faulty or not as described in our specifications. I this instance we will offer a full refund excluding shipping once the goods are returned to us in their original packaging however you will be responsible for the cost of returning the goods. Upon receipt of the product, we will refund monies within 30 days.

Complaints

In the event that the “COMPANY” fail to meet the high standards of customer service, please do not hesitate to contact the “COMPANY” directly, form our Contact page. Whatever the circumstances the “COMPANY” will endeavour to make every effort to meet your expectations and retain you’re much valued- custom.

Statutory Rights

Nothing contained within these T & Cs affects or will affect the statutory rights of the “PURCHASER” or the recipient in relation to the quality, fitness or description of the goods supplied.

Limitation of Liability

We do not accept responsibility that the website, its servers, or e-mail sent from the website are free of viruses or other harmful components. We will not be liable for any damages of any kind arising from the use of the website, including, but not limited to direct, indirect, incidental, punitive or consequential damages. Certain laws do not allow limitations as contained in this clause. If these laws apply, some or all of the above limitations may not apply to you and you might have additional rights.

Data Protection & Privacy

The “COMPANY” value its customer’s privacy and work on a non -disclosure basis and do not pass on client information to third parties. In order for the “COMPANY” to process an order we have to collect your name, address, e-mail address, telephone number (s). The “COMPANY” also constantly monitor traffic patterns so we can constantly improve our website however if “YOU” would prefer not to receive information from the “COMPANY” on promotions please opt out of the mailing list.

These “T & Cs” shall be governed, construed and shall take effect in accordance with the laws of England and Wales and be subject to the jurisdiction of the English courts. If any of these “T & Cs” are ineffective for any reason, the remainder of them shall form the T & Cs binding “YOU” and the “COMPANY”. Any failure by the “COMPANY” to enforce at any time any of these “T & Cs” this shall not be construed as or deemed to be a waiver by the “COMPANY” of its rights under this agreement nor shall failure in any way affect the validity of the whole or any part of these “T & Cs” and the “COMPANY’S” right to take subsequent action shall not be prejudiced by such failure.
